1. Quick Overview
- Magic Nothing is a marketplace that connects indie artists with playlist curators. Artists pay for reviews of their music by playlist curators — not guaranteed placements.
- We use a token system. 1 token = $1 USD. You buy tokens, spend them on submissions, and curators earn tokens for reviewing your music.
- Curators are independent. They decide what goes on their playlists. We don't control their decisions.
- You own your music. We only use it to show curators your submission. That's it.
- No guarantees. We can't promise playlist placements, streams, followers, or any specific career outcome.

2. Who We Are
Magic Nothing Inc ("Magic Nothing," "we," "us," or "our") operates an online marketplace that connects independent artists and music creators with playlist curators. We facilitate the connection between artists who want their music heard and curators who maintain playlists — but we don't guarantee any particular outcome from that connection.
By creating an account or using Magic Nothing (the "Platform"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the Platform.
3. Accounts
3.1 Eligibility
You must be at least 18 years old to create an account or use Magic Nothing. By creating an account, you represent that you are 18 or older. We do not knowingly collect information from anyone under 18.
3.2 Account Security
You're responsible for keeping your login credentials secure and for all activity that happens under your account. If you suspect unauthorized access, contact us immediately at info@magicnothing.com.
3.3 Communications
By creating an account, you consent to receive service-related communications from us via email, including account notifications, submission updates, security alerts, and notices about changes to these Terms. These are transactional communications necessary to operate the Platform, not marketing. You can opt out of promotional communications at any time.
3.4 One Account Per Person
Each person may maintain only one account. You may use the same account as both an artist and a curator. Creating multiple accounts to evade restrictions, manipulate the system, or for any other purpose is a violation of these Terms and may result in all associated accounts being terminated.
4. How the Marketplace Works
4.1 What You're Paying For
When an artist submits music to a curator's playlist, they are paying for a guaranteed review — meaning the curator will listen to the submission and provide feedback. A submission is not a purchase of a playlist placement. Curators independently decide what music fits their playlists.
4.2 Curator Expectations
Curators on the Platform are expected to:
- Review submissions within the timeframe displayed on the Platform
- Provide honest, constructive feedback
- Maintain accurate information about their playlists
4.3 Our Role
Magic Nothing is a facilitator. We connect artists with curators and provide tools to make the process smooth, but we do not control curator decisions, guarantee outcomes, or endorse any particular curator or playlist.
4.4 Quality Tier System
Playlists on Magic Nothing are assigned quality tiers based on objective performance metrics. Higher-tier playlists cost more to submit to and pay curators more for reviews. See Section 5 for pricing details.
5. Tokens & Payments
5.1 Token System
Magic Nothing uses a token-based system for all transactions on the Platform. 1 token = $1.00 USD. Tokens are purchased through our payment processor(s) and are used to pay for submissions to curator playlists.
5.2 Pricing Tiers
Submission costs and curator earnings vary by playlist quality tier. Playlists are scored on objective performance metrics, and higher-quality playlists cost more to submit to. Current pricing for each tier is displayed on the playlist when you submit.
For every submission, the cost is split between the curator and the Platform. Magic Nothing retains the difference between what the artist pays and what the curator receives as a platform fee to operate the service. Higher-tier playlists generally earn curators a larger share of the submission cost. Top-rated curators may also earn a premium bonus on top of base rates.
5.3 Payment Processing
All payments are processed by Stripe and are subject to Stripe's terms of service. Magic Nothing does not store your credit card information.
5.4 Token Transferability
Tokens are non-transferable between accounts. You may not sell, trade, gift, or otherwise transfer tokens to another user.
5.5 Service Discontinuation
Tokens have no cash value outside the Platform. If Magic Nothing discontinues the service, we will provide 90 days' notice and honor outstanding token balances for cashout-eligible curators. Magic Nothing will refund purchased but unused tokens to the original payment method within 90 days of the discontinuation date. If refund to the original payment method is not possible, we will offer an alternative method.
6. Refunds & Cancellations
6.1 Reviewed Submissions
Submissions that have been reviewed (accepted, declined, or placed elsewhere) are non-refundable. You paid for a review, and the curator provided one.
6.2 Expired Submissions
If a submission expires without being reviewed by the curator, your tokens are automatically refunded to your token balance.
6.3 Platform Errors
If a platform error results in lost tokens or an incorrect charge, we will correct it. Contact us at info@magicnothing.com with details.
6.4 Duplicate Purchases
If you are charged twice for the same transaction, contact us and we will correct the duplicate.
6.5 Chargebacks
Filing a payment dispute or chargeback through your bank may result in your account being suspended pending investigation. If you believe a charge is incorrect, please contact us first so we can resolve it directly.
6.6 Statutory Rights
Nothing in these Terms limits your rights under applicable consumer protection laws, including EU cooling-off periods or other statutory protections that may apply in your jurisdiction.
7. Artist-Curator Disputes
7.1 How to Report
If you have a dispute with a curator (e.g., low-quality feedback, inaccurate playlist information, or other concerns), email info@magicnothing.com with the details of your submission and the issue.
7.2 Investigation & Resolution
We will investigate reported disputes and may take the following actions:
- Issue a token credit to the artist
- Issue a warning to the curator
- Suspend or remove the curator from the Platform
We aim to respond to disputes within 10 business days.
7.3 Finality
For disputes under $50 USD (50 tokens) in value, the Platform's resolution is final. This does not limit your legal rights under applicable law.
8. Curator Relationship
8.1 Independent Contractor Status
Curators on the Platform are independent contractors, not employees, agents, or representatives of Magic Nothing. We do not control how curators evaluate music, set their schedules, or manage their playlists.
8.2 Curator Expectations
While curators maintain independence in their review approach, they are expected to:
- Review submissions within the timeframe displayed on the Platform
- Provide honest, constructive feedback
- Maintain accurate and up-to-date playlist information
8.3 Earnings & Cashout
Curator earnings and cashout procedures are governed by the Creator Agreement, which curators accept when they join the Platform as curators.
9. Your Content & Intellectual Property
9.1 Ownership
You own your music. Full stop. Submitting music through Magic Nothing does not transfer any ownership rights to us.
9.2 License to Magic Nothing
By submitting content to the Platform, you grant Magic Nothing a limited, non-exclusive, revocable license solely to:
- Display your submission on the Platform
- Share your submission with curators for review purposes
- Use submission data to operate, analyze, and improve the Platform's services (including quality scoring and analytics)
We will not use your music in our own marketing, playlists, compilations, or for any other purpose without your separate written permission. We will not sublicense your content to third parties.
9.3 License Termination
This license terminates when you delete your account or remove the content from the Platform.
9.4 Copyright Infringement (DMCA)
If you believe content on the Platform infringes your copyright, contact us at info@magicnothing.com with:
- Identification of the copyrighted work
- Identification of the infringing material on the Platform
- Your contact information
- A statement of good faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act on their behalf
We will respond to valid DMCA notices within 10 business days.
10. Platform Content
All Magic Nothing branding, logos, design elements, and original content (including text, graphics, and software) are the property of Magic Nothing Inc or its licensors. You may not copy, modify, distribute, or use any of our content without prior written permission.
11. Third-Party Services & Spotify
11.1 Third-Party Integrations
Magic Nothing integrates with third-party services including but not limited to Spotify, Stripe, and Discord. Your use of these services is governed by their own terms of service and privacy policies. We are not responsible for the availability, accuracy, or actions of any third-party service.
11.2 Spotify-Specific Risks
We are not responsible for:
- Spotify removing tracks, playlists, or accounts
- Changes to Spotify's algorithm, API, or service
- Spotify's enforcement actions against artists, curators, or playlists
- Any loss of streaming revenue or audience resulting from Spotify's independent decisions
11.3 Artificial Streaming & Playlist Integrity
We want to be straightforward about how artificial streaming works in the playlist ecosystem:
What Spotify does: Spotify independently monitors streaming activity and may take action against tracks, playlists, or accounts it flags for artificial streaming — even if the artist or curator didn't cause or request it. Spotify and music distributors have far more comprehensive tools for detecting artificial streaming than any third party. We defer to their expertise and enforcement.
What our system does: Our quality tier system evaluates playlists on real performance metrics such as engagement and artist satisfaction. Playlists with low genuine engagement naturally rank lower and cost less to submit to. This is a metrics-driven system, not manual playlist verification.
If we discover a problem: If we become aware that a curator on our Platform is engaging in artificial streaming or manipulation, we will investigate and take action, including removal from the Platform.
If you're affected: If an artist is impacted by a Spotify enforcement action related to a submission made through Magic Nothing, we will make reasonable efforts to provide their submission history and review timestamps to support any dispute with Spotify or their distributor.
To be clear: Spotify's enforcement actions are Spotify's independent decisions. They are not a Magic Nothing "platform error" and are not eligible for token refunds under Section 6. However, if a curator on our Platform is found to be engaging in artificial streaming, we will take separate action regarding that curator relationship.
12. AI Features
Magic Nothing uses AI tools (such as language models) to assist with certain features. Current and planned AI features may include screenshot analysis, bio generation, and feedback suggestions. When AI is used:
- You retain full control over whether to use AI-generated content
- AI-generated content is provided as a starting point — always review and edit before publishing
- We do not guarantee the accuracy, originality, or suitability of AI-generated content

13. Prohibited Conduct
You agree not to:
- Use bots, scripts, or automated tools to interact with the Platform
- Create or maintain multiple accounts
- Submit content that infringes on others' intellectual property
- Harass, threaten, or abuse other users
- Attempt to hack, reverse-engineer, or compromise our systems
- Sell, trade, or transfer tokens to other users
- Post spam, misleading information, or malicious content
- Engage in stream manipulation or artificial engagement schemes
- Arrange off-platform payments for playlist placements found on Magic Nothing
- Engage in fraud or misrepresentation of any kind
Violations may result in warnings, suspension, or termination as described in Section 14.
14. Account Suspension & Termination
14.1 Tiered Enforcement
For most violations of these Terms, we will issue a warning via email to your registered address before taking further action. Repeated or severe violations (including fraud, harassment, or illegal activity) may result in immediate suspension or termination without prior warning.
14.2 Suspension
Suspension is temporary. Your account will be frozen, and you will be notified by email of the reason for suspension and how to appeal.
14.3 Termination
Termination is permanent. Your account will be closed and you will no longer have access to the Platform.
14.4 Token Balances on Termination
- Artists: Unused purchased tokens will be refunded to the original payment method within 30 days, except where the termination resulted from fraud or illegal activity.
- Curators: Earned tokens above the cashout minimum will be paid out within 30 days. Tokens earned through activity that violated these Terms may be forfeited.
14.5 User-Initiated Closure
You may close your account at any time by contacting support at info@magicnothing.com. For curators, earned token cashout is subject to standard processing under the Creator Agreement.
14.6 Appeals
If your account is suspended or terminated, you may appeal by emailing info@magicnothing.com within 30 days. Include your account details and any information relevant to your case.
15. Disclaimers
Magic Nothing does not guarantee:
- Playlist placements, streams, followers, or any specific career outcomes
- The quality, accuracy, or reliability of any curator, playlist, or content on the Platform
- Uninterrupted or error-free service
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
16. Limitation of Liability
Magic Nothing's total liability to you for any claim arising from or related to these Terms or your use of the Platform is limited to the greater of: (a) the amount you paid to Magic Nothing in the 12 months preceding the claim, or (b) $100.
Magic Nothing is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Lost profits or revenue
- Lost data
- Loss of streaming revenue
- Spotify or other third-party enforcement actions
- Reputational harm
These limitations apply to the fullest extent permitted by applicable law.
17. Indemnification
You agree to indemnify and hold Magic Nothing, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Content you submit that infringes third-party intellectual property
- Fraudulent activity on your account
- Your violation of these Terms
This is not a blanket indemnification for any use of the Platform — it is limited to the specific situations listed above.
18. Dispute Resolution
18.1 Step 1: Informal Resolution
Before filing any formal claim, you agree to contact us at info@magicnothing.com and give us 30 days to try to resolve the issue informally.
18.2 Step 2: Binding Arbitration
If informal resolution fails, any dispute arising from or relating to these Terms or your use of the Platform will be resolved through binding arbitration administered by JAMS under its applicable rules, in Los Angeles, California, except where prohibited by applicable law.
18.3 Small Claims Exception
Either party may bring claims in small claims court if the dispute qualifies, instead of proceeding to arbitration.
18.4 Class Action Waiver
All disputes must be brought in your individual capacity, not as a plaintiff or class member in any class action, collective action, or representative proceeding.
18.5 Opt-Out Right
You may opt out of this arbitration agreement within 30 days of creating your account by emailing info@magicnothing.com with the subject line "Arbitration Opt-Out" and including your name and account email. If you opt out, disputes will be resolved in state or federal court located in Los Angeles County, California.
19. Data & Privacy
In brief, we collect and process:
- Account information: name, email, profile details
- Usage data: how you interact with the Platform
- Payment data: processed securely by Stripe (we don't store card numbers)
- Submission and review data: the content of submissions and curator feedback
- Curator submission data: artist music and feedback shared with curators for review purposes
We do not sell your personal data.
AI features process certain data as described in Section 12.

20. Changes to Terms
Material changes — including changes to pricing, refund policy, arbitration provisions, or your rights — will be communicated via email to your registered address at least 30 days before they take effect.
Non-material changes (clarifications, formatting, minor updates) will be posted with an updated "Last updated" date at the top of this page.
If you disagree with a material change, you have the right to close your account before the change takes effect. Continued use of the Platform after the notice period constitutes acceptance of the updated Terms.
21. General
21.1 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
21.2 No Waiver
Our failure to enforce any term or right does not constitute a waiver of that term or right in the future.
21.3 Assignment
Magic Nothing may assign these Terms in connection with a merger, acquisition, or sale of assets, with notice to you. You may not assign your rights or obligations under these Terms without our prior written consent.
21.4 Force Majeure
Magic Nothing is not liable for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, acts of government, internet outages, or other force majeure events.
21.5 Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
21.6 Entire Agreement
These Terms, together with our Privacy Policy and the Creator Agreement (for curators), constitute the entire agreement between you and Magic Nothing regarding your use of the Platform.
